In the suit which had been slated to hold in Abakaliki on Monday 21 September, 2020 before the Chief Judge of Ebonyi State; the petitioner, Barr. Kelechi Chukwu who is an indigene of Oshiri In Onicha Local Government Area Of the state said that “the appointment of Caretaker Chairmen into the 13 Local Government Councils of Ebonyi State by the Governor of Ebonyi State (the 1st Defendant), instead of conducting elections to democratically elect those who will occupy the positions in accordance with the provisions of the Constitution of the Federal Republic of Nigeria is in total breach of the Constitution, adding that the State House of Assembly has no power to make any law empowering the Governor to appoint Caretaker Committee Chairmen into the Local Government Councils”.

The Legal Practitioner, Barr. Kelechi, therefore requests the Court to set aside the appointment of the Caretaker Committee Chairmen and also compel them to refund any money collected while illegally occupying the said offices.

He also requests for an order of Court setting aside section 26 of the COVID-19 Law of Ebonyi State that purports to empower the Governor to appoint Caretaker Committee Chairmen to the local Government councils in the state.

However, in a Press Release signed by Chief Barr. Samuel Okoronkwo (Hon. Commissioner for Local Government, Chieftaincy Matters and Rural Development), and Hon. Barr. Orji Uchenna Orji
(Hon. Commissioner for Information and State Orientation), the state governor, Engr. Dave Umahi directed the Ebonyi State Independent Electoral Commission (EBSIEC) “to immediately commence activities for the conduct of the 2020 Local Government Elections in the State as required by law”.
